The agreement
These Terms of Service (“Terms”) govern your use of CRMSix: the website at crmsix.com, the application at login.crmsix.com and each organization’s own address, the mobile app and the API (the “Service”), provided by CRMSix (“CRMSix”, “we”, “us”). If you accept these Terms for an organization, you confirm you have authority to bind it, and “you” and “customer” mean that organization. If you do not agree, do not use the Service. Our Privacy Policy explains how we handle personal data.
Accounts
- The Service is for businesses. You must be at least 18 to use it.
- Keep the details you give us accurate, and keep passwords, API keys and other credentials secret. You are responsible for what happens under your organization’s account and its users’ sign-ins.
- Your organization’s administrators control who has access and what each user can do. Tell us at security@crmsix.com straight away if you suspect unauthorized access.
Trials, plans and payment
- Trials: a free trial lasts for the period shown when you sign up. When it ends, the organization can no longer be used until it moves to a paid plan; we keep its data for a reasonable period so it can.
- Plans: subscriptions are priced per user (licence) per month, billed monthly or annually in advance, at the prices shown on our pricing page or agreed in writing. Licences added during a billing period are charged for the rest of that period.
- Usage: some features have usage limits or are charged by use, as described in the Service (Settings → Usage & Limits) or your plan.
- Payment: invoices are due within 14 days. If an invoice is overdue we may restrict the Service after telling you. Fees are exclusive of taxes, which you pay where they apply. Fees already paid are not refundable, except where the law requires it or we say otherwise.
- Renewal and price changes: subscriptions renew for the same period unless cancelled before the renewal date. We give at least 30 days’ notice of a price increase, which applies from your next renewal.
Your data
- Your organization owns the data it puts into the Service (“Customer Data”). You give CRMSix permission to host, process and transmit it only as needed to provide, secure and support the Service, and as you instruct through the Service.
- You are responsible for Customer Data and for having the right to collect and use it, including the consent of people you email or contact through the Service.
- You can export your data at any time from Settings → Data Export, and through the API.
- We process personal data in Customer Data as your processor, as described in our Privacy Policy. A data processing agreement is available on request.
Acceptable use
You must not, and must not let others:
- break the law, or infringe or misuse anyone else’s rights or personal data;
- send spam or unsolicited bulk messages, or email people who have opted out;
- upload malware or content that is unlawful, harmful or abusive;
- try to access other organizations’ data or bypass security, sign-in, limits or permissions, or test the Service’s security except under our responsible disclosure policy on the Security page;
- overload the Service or exceed its usage limits on purpose, or reverse engineer it except where the law allows;
- resell the Service, or use it to build a competing product.
Connected services and AI
- Some features work with services you choose to connect, such as Google Calendar and Meet, or your email provider. Their own terms apply to your use of them, and we are not responsible for them.
- When your organization turns on the AI assistant, answers are produced by an AI model and can be wrong or incomplete. Check important information before you act on it. Changes the assistant proposes are made only after you confirm them, and you are responsible for the changes you confirm.
The service
We work to keep the Service available, secure and backed up, and we post its status at status.crmsix.com. We may improve, change or retire features; we will not materially reduce the core functions of a paid plan during its current billing period. Service level commitments apply only where agreed in writing. We may make maintenance changes, ideally outside business hours.
Intellectual property
CRMSix and its licensors own the Service, its software and its content. We grant you a non-exclusive, non-transferable right to use it during your subscription under these Terms. If you send us feedback or suggestions, we may use them without obligation to you.
Confidentiality
Each of us will keep the other’s non-public information confidential, use it only for this agreement, and protect it with reasonable care, except where it is already public, was independently developed or received lawfully, or must be disclosed by law.
Suspension and termination
- You can cancel at any time; cancellation takes effect at the end of the current billing period.
- We may suspend access immediately if it is needed to protect the Service, other customers or the law, or for a serious or repeated breach of these Terms, and we will tell you why. We may end the agreement if a breach is not fixed within 30 days of notice, or if invoices remain unpaid.
- After the agreement ends, you can export your data for a reasonable period on request; after that we delete it, as described in our Privacy Policy.
Disclaimers
Except as expressly stated in these Terms, the Service is provided “as is” and “as available”. To the extent the law allows, CRMSix makes no other warranties, express or implied, including of merchantability, fitness for a particular purpose and non-infringement, and does not promise the Service will be uninterrupted or error-free.
Limitation of liability
To the extent the law allows, neither party is liable for indirect, incidental, special or consequential damages, or for lost profits, revenue or data, and each party’s total liability under this agreement is limited to the fees paid or payable by the customer to CRMSix in the 12 months before the claim. These limits do not apply to the customer’s payment obligations, to breaches of the acceptable use rules, or to liability that cannot be limited by law.
Indemnity
You will defend and compensate CRMSix against claims by third parties arising from Customer Data or from your use of the Service in breach of these Terms or the law.
Governing law
These Terms are governed by the laws of India. The courts of India have exclusive jurisdiction over any dispute arising from them, and both parties submit to that jurisdiction.
Changes to these terms
We may update these Terms. We will change the effective date above and tell customers’ administrators about significant changes at least 30 days before they take effect. Continuing to use the Service after that means you accept the updated Terms.
